KUALA LUMPUR: Pemilik rumah yang enggan atau tidak membayar yuran penyelenggaraan, mungkin menghadapi risiko rumah mereka dilelong oleh Badan Pengurusan Bersama (JMB) bagi menyelesaikan tunggakan yuran mereka.
Setiausaha Agung Persatuan Kebangsaan Pembeli Rumah (HBA), Chang Kim Loong, berkata langkah itu boleh dilaksanakan mengikut mengikut Akta Bangunan dan Harta Awam (Penyelenggaraan dan Pengurusan) 2007 membabitkan kira-kira 500,000 bangunan tinggi yang perlu memohon hak milik strata di seluruh negara.
Lapan hingga 12 pemilik perumahan dengan maksimum dua wakil pemaju membentuk JMB yang akan menyelenggara harta awam, memutuskan jumlah bayaran yuran penyelenggaraan dan mengutip bayaran itu daripada pemilik perumahan.
Bagaimanapun beliau berkata, masih banyak perumahan di bawah hak milik strata belum mempunyai JMB walaupun kerajaan menetapkan 12 April lalu sebagai tarikh akhir pemaju membentuk JMB.
Sebelum akta itu dikuatkuasakan, pemilik apartmen terpaksa menunggu bertahun-tahun supaya pemaju menukar hak milik utama kepada hak milik strata individu.
Dalam jangkamasa itu katanya, pemaju bertanggungjawab mengawal penyelenggaraan dan pengurusan apartmen dan mereka biasanya melantik syarikat pengurusan atau rakan kongsi perniagaan.
Menurutnya, undang-undang berkenaan dapat memberikan kelegaan kepada pemilik perumahan yang terpaksa menanggung perkhidmatan kurang memuaskan daripada syarikat pengurusan.
“Masalah dialami pemilik, termasuk tandas awam kotor, longkang serta paip tersumbat dan tiada lampu di tangga membahayakan keselamatan penghuni.
“Masalah ini dapat diatasi melalui pembentukan JMB sebelum mereka mendapat hak milik strata individu di mana pemilik turut mempunyai kuasa membuat keputusan,” katanya ketika ditemui selepas Forum Bangunan dan Harta Bersama - Penyelenggaraan dan Pengurusan dianjurkan kerajaan negeri, di sini, semalam.
Menurutnya, akta berkenaan bukan saja memberi kelebihan kepada pemilik rumah, malah juga kepada pemaju atau syarikat pengurusan berikutan sebelum ini mereka mengalami kesukaran memungut yuran penyelenggaraan kerana ramai pemilik liat membayarnya.

SYARAT-SYARAT MELETAK KENDERAAN BAGI PELAWAT
Pelawat hanya dibenarkan meletak kenderaan di petak meletak kenderaan pelawat.
Pelawat tidak dibenarkan meletak kenderaan dipetak letak kenderaan tuan rumah atau ditempat-tempat lain.
Pelawat mesti mempamirkan plakad ini diatas “dashboard” kenderaan sepanjang masa ketika berada dalam kawasan Vila Duta Condominium.
Pelawat boleh dilarang masuk jika enggan mematuhi syarat-syarat ini.
CONDITIONS FOR PARKING VEHICLES BY VISITORS
Visitors shall only park their vehicles at designated visitors parking lots.
Visitors shall not park their vehicles in owners’ parking lots or at any other places.
Visitors must display this placard on the dashboard of their vehicles for the duration of their stay within the premises of Villa Duta Condominium.
Visitors may not be permitted access to the premises if they fail to comply with these conditions.
I want to express my gratitude to the JMB team for taking up the responsibility of sorting villa dutta up. A lot have improved, pool is working, lights everywhere is working, autogate is in process, etc. Well done. I do however, have a concern. There is a unit thats at my floor that have been vacated and the authoroties have 'confiscated' the items in the apartment. After that, i doubt if there are any locks and suspect that somebody is living in the apartment illegally. I will inform the security guard of this today to check it out. So maybe, we can suggest the guards to do a scheduled checks block by block on all deserted apartments. It doesnt have to be done in one day, maybe throughout 1-2 weeks. Lastly, we should advertise this blog more...and maybe have a day where we, the residents, can meet all of you in the team, to give a pat at the back or to raise any more concerns. Regards,

This meeting is very important for all residents to enable some action to be taken against defaulters and also to determine the operations of the Autogate in relation to security etc.

Good Jobs done by the newly appointed JMB commitee members for the past 3 month effort to upgrade the condos. For the past 3 month, we need to praised to their tremenemuous effort such as lighting and security and Boom Gate been installed. The moves is enhancing our valueable property in living and money value. For the past 10 year, our property value is depreciates insteads of appreciation that against the economy concepts that prorperties is best value to flight against inflation instead of the cash or others assets we hold..

Dear to non payment master of VILLA DUTA RESIDENTS,
strongly urged to the resident to pay the outstanding debt .. because we cannot afford to subsidi the defaulter anymore.. How can we to pay syabas with the maintenance fees, how long to can sustain like this.. I strongly agreed to cut the water is best measurement to solved this matters. If the problem persist, I will stop my payment of maintenance to JMB anymore because I do not want to subside others people anymore..I maintenance my balance as same level and amout as other defaulters.. For sure I going to do and promised...
May I know where is the designated visitor's parking area? Is it only in front of the guard house?
why the charges for the access card is so high? on what basis/method that the sum is being worked out.
Pertama sekali tahniah atas usaha JMB memperbaik keadaan pengurusan VDC. Walau bagaimanapun harga kad akses memang terlalu tinggi khususnya untuk kenderaan ke-2. Tambah merumitkan lagi, penyewa tidak dibenarkan membeli kad tersebut melainkan pemilik rumah memberikan surat kebenaran, menyerahkan salinan S&P, dan menguruskan pembayaran yuran penyelenggaraan yang tertunggak. Masalahnya kami sebagai penyewa sentiasa melangsaikan yuran penyelenggaraan setiap bulan. Sekiranya ada pemilik yang enggan berkerjasama membayar baki tertunggak, adakah kami sebagai penyewa yang dijadikan mangsa? Harap JMB dapat memikirkan jalan yang terbaik agar kami tidak terhimpit dalam masalah ini.
Thank you for the comments and queries: The JMB answers as follows:
1. Card Access, why so expensive?
The cost of the card is calculated on the basis of the gate must be self financing, that is we do not use maintenance money for it.
Further, upon vacating (by sale of unit or giving up the tenancy agreement) you may go to the JMB office and resell the card and have the money refunded provided always that the card is in working condition, and not defaced.
For most other condos, yes they do sell the cards cheaper, but then the developer had already installed the gate and the cost of which is built into the price of the house.
Some condos are also charging for rental of parking lot (2nd car) whereas we are not.
We hope the queries about the cost of the cards are answered, if not you may at any time ask the office to refer you to the proper person to give you a fuller explanation.
Also, we intend to use the balance collected to install CCTVs around the Condo and to repair the intercom system to better enhance security.
2. Outstanding maintenance charges
On this issue, all condos face this problem and all with autogate always tie one to the other,
That is the cards are always tied to maintenance, if you do not pay they deny your car entry.
For tenants, we understand the difficulty in getting the owners, we face the same problem, in getting them to pay the maintenance.
However, if you face a problem please go to the office and ask to speak to an officer of the JMB who would only be too happy to assist you.
Lastly, there is no immediate or magical solution that will answer all the problems frace by the JMB and Owners as well as tenants.
But in order for us to work together and be happy with the investment poured into Villa Duta in terms of your purchase price (owners) or rentals every month (tenants) I would like to appeal to you to consider that there is no better alternative than spending 10 minutes at the office to discuss things out.
If you need to meet with any member of the JMB please enquire and request at the office, call them and make an appointment.
They are available at any time to assist.
I also urge all of you who have not paid up maintenance either by choice or design to do so as you are only hurting the price of the property and hurting your neighbours who pay but get bad service as we have limited funds to work with.

Sejak 1 minggu yang lepas, VDC condo ada panther masuk .. anak & ibu panther masuk kerana dalam hutan sudah kekurangan makanan. Terpaksalah gang panther untuk buru babi hutan ka VDC...
Hakikatnya, gang panther ini kena ambil risiko untuk tembak oleh pegawai wildlife ... Ini lah ceritanya bahawa dunia ini tidak free lunch kerana panther kena gadai nyawa untuk babi hutan......
Tapi, penghuni VDC lagi teruk lagi daripada panther kerana semua mau free tapi alasan untuk tidak bayar maintenance banyak sangat sampai gunung.
Rasa ini penghuni kena tembak pun tidak memadai juga kerana panther masih tau segan dan menyorok dalam hutan untuk tunggu peluang makanan dan tau segan .
Tetapi penghuni VDC (yang tak bayar) langsung tak tahu segan langsung kerana semua mau percuma lagi sambil tunjuk garang lagi..
I rasa, non-payers tu mesti hutang dah banyak, so maybe takde duit nak bayar ker, malu ker. Why not the mgmt offer them to start paying the current month and so on, pastu hutang lama tu dorang bayar sikit2, for eg. $200 for maintenance + extra $100 a month until the hutang settle. Then limit 1 card only until the hutang settled. Just my 2 cents.. and 1 more thing, just curious, our covered parking is limit to 1 unit only is it? and with the 2 cards, are we gonna get 2 covered parkings?
Rumours says that there will be some Ironcore (harder then hardcore)that will block the Boom Gate , because he don't want to pay andy bills, or buy any cards.
Why don't go and stay at you parents house there maybe you can get free stuff, but not always.

For those who don't know where to pay, kindly follow this direction:-
1. After the guard house, take a VERY DANGEROUS CORNER. Then you will see a boom gate ahead.
2. Go straight, on your left, you will see a VERY DIRTY COURT.
3. As you proceed, you will find a VERY DISGUSTING CAFE.
4. Follow along the curve and go up the slope. On your right, you will find a VERY DESERTED CONDO.
5. After 100 feet, look for a parking. Walk up the foyer and turn left. You will find a VERY DARK CORRIDOR. After the door, look left. Thats the office lor!!! So now please pay your BILLS!
dear all, it's not fair to blame the current JMB.. they are our neighbours u know "our people".. not our past problematic mgmt.. nobody pays them to look over our properties, if you non payers have been elected by the residents to do this job, will you take the responsibilities? i don't think so.. so please give your best cooperation towards our own neighbour.. please continue to pay up the bills.. and live happily ever after..

Tragedi 21/08/08 adalah suatu pengajaran kepada pemilik VDC yang masih berdegil membayar hutang tertunggak. Apapun gara-gara sikap sipemilik, sipenyewa turut menjadi mangsanya. Saya bersetuju dengan pandangan dan cara penyelesaian yang dicadangkan oleh Lily. Kelonggaran untuk membeli kad akses sepatutnya diberikan kepada penyewa yang membayar bil/yuran semasa. Harap pihak JMB berbudi bicara terhadap hal ini. Tetapi sejak semalam, saya perhatikan masih ada juga kereta tanpa kad akses dibenarkan masuk oleh pengawal kita. Mengapa ada pula yang dapat keistimewaan? Mohon pihak JMB menyiasat hal ini.
Any culprit that tried to stop COB to issue the certificate for the JMB, have to know that above the SKY there's still another SKY. Congratulation to JMB for recieving the certificate from COB, and feel sorry for the resident that did not wanted this to happen, but it happen.

APA....NI.....please lah, what about the atap for the touch card area, I can't even open my car window to touch the card, and my relative was behind me, couldn't go down and register. Other or most of the condos, the car can park beside the Guard house and register with out going down from the car rain or not rain, we call sevice, if you want to impletment all rules please give us a comfortable way to use the facility we are paying for. Please look into this matter urgent, because raining season is on the way, hope to see some changes soon.

Thank you for your comments, we are in the midst of sourcing for the cover for the boomgate and will be installing the lights by the weekend as the cables are in place.
The cover may take some time so please bear with us.
As for the visitors, we are looking at ways to overcome this but the design and location of the guardhouse is meant for a pull gate.
The JMB needs time and constructive feedback like this to improve ourselves and the condo specifically.

The lights at the boom gate on loan (bukan curi) from an existing but not used lampost at Block B.
As we know it is dark we decided to use that lampost pending the installation of the cover for the card access slot.
We are looking at various options to try and better illuminate the area.
This is merely a temporary measure until we get a better solution to the problem.

Errant high-rise builders warned
Iskandar: ‘They are liable to a fine of between RM10,000 and RM100,000, if found guilty’
DEVELOPERS of high-rise buildings in Selangor who have not submitted applications to obtain strata titles will face legal action from the state government.
State housing, building management and squatters committee chairman Iskandar Abdul Samad said the state had ordered the local authorities to go after the culprits.
He said at least two such developers from Gombak and Petaling had been dragged to court under Section 8 of the Strata Title Act 1985.
“They are liable to a fine of between RM10,000 and RM100,000, if found guilty,’’ he said
Iskandar said the various local authorities were also in the process of taking more than 30 developers to court.
He said the offenders were from Hulu Langat and other parts of Selangor.
“The majority of the cases are being handled by the State Land Office,’’ he added
After so many years, Iskandar said the time had come for the developers to be penalised.
He said the irresponsible attitude of these developers had caused a lot misery for owners of high-rise homes in Selangor.
‘‘We have been receiving too many complaints from residents and owners of high-rise homes and we cannot tolerate this nonsence anymore,’’ he said
Iskandar urged all developers of high-rise building to be responsible by submitting their applications for the strata titles.
SalamMK.I heard from my Nabour that the JMB (Managment) is changing the Boomgate system from Touch Kard o Sensor System. It happen once to me, when I wanted to touch the kard when is was raining, the rain por in to my car and hit the window controll board, but luckily nothing happen. I hope the system will come ASAP.

JMB is in the process of indentifying and shortlisting the various applicants for the cafe operations.
There are also some repair works such as the doors, windows and clearing of debris and to also look into grease traps and proper waste disposal prior to confirming the new operator.
We estimate that the cafe will open some time after Aidil Fitri or the latest end October, 2008.

i want to ask when we can get our refund back. for the insurance and quite rent that we have paid. previously said we can get back the refund, but until now i still couldnt get it. even i had make application 3 months ago, wrote a official request letter a month ago to ask for contra the maintenance fee. but still no news and no contact, no explaination from the managament. well, saying that if we owe maintainance fee more than 2 months, will terminate the access card. but what about owning our money?? i hope that no double standard at here.
some comittee member already got the refund more than 2 months ago, but for us ordinary residents still no respond.

I had this really 'fishy' feeling about the parking allocations in Villa Duta. I am really confused on the whole system because I am hearing different stories from different people. I have seen residents parking their 3rd car in an empty bay, and I have residents telling me that they are eligible for 2 covered car parks. I have seen residents parking their cars not in their bays. I have seen outsiders parking in our car parks, but some residents who need to park their 2nd car at the visitor carpark. There are cars who enter without car stickers and access cards, but with a 'honk' to sound the guards. Some don't even need to 'honk' but with a 'wave' You know... I don't feel safe anymore staying here. There is an invisible rules that rules with their own standards and the guards were given different instructions.
I went to see the mgmt for a proper understanding, 1 said they are not responsible on the arrangements. 1 didn't pick up call. 1 said that the arrangements were done in accordance to the 'law'...so where should I turn to? I am not here to judge, but I need some advice on moving forward. Anyone please?
Villa Duta have problem because resident don't pay there bills, and thos ewho is a good paymaster have face allot of problem because of the irresponsible resident, please pay up your bills, thenwe will have a peaceful life.
If the resident keep on not paying the maintanence fee and water bill, then it will happen to us also, but why everybody is paying the electric Bills????????? all knows the answer, have to pay otherwise cut, and because electric meter belongs to TNB, can not avoid paying.

Taps run dry due to unpaid bills
OUTSTANDING water bills amounting to RM52,865.52 as of yesterday led to the disconnection of water supply at the Subang Permai Apartment in USJ 1.
The residents in the 260 units in the apartment found out that water stopped flowing through their pipes since about 11am on Tuesday.

Joint Management Body (JMB) chairman Joyce Lee said they do not have sufficient funds to settle the bills.
“When the JMB was formed last May, there was no collection from the residents in the first few months as we were still working out the details. It was then that the water bills accumulated,” she said.
The JMB has been paying the bills since July in installments upon an agreement with Syabas.
“We cannot afford to settle the full amount but we make sure that we pay a certain amount each month.
“The collection from the residents is always slightly below what we expect because not everyone pays,” Lee said.
According to her, major underground water leakage also contributed to the amount of the water bills.
“We found out that water meter readings did not tally with that on the bills. We checked and found at least five burst pipes.
“Clear water was gushing out into the drains and we quickly employed plumbers to fix the problem,” Lee said.
Besides the repair works, the JMB also forked out money from the account to replace faulty water meters for about 40 units.
“It cost us RM112 to replace one meter - RM92 for the meter and RM20 for the installation,” Lee said.
As a result of the water cut, some residents promptly settled their bills with the management yesterday morning.
The JMB has also reached an agreement with the residents to remove their water meters if they had not paid their water bills for more than three months.
“Those who are owing less than three months will be given two more weeks to pay up,” Lee said.
The JMB also paid another RM10,000 to Syabas yesterday, hoping that the water supply would be reconnected.
“As per our earlier conversation, a Syarikat Bekalan Air Selangor (Syabas) officer demanded at least RM20,000 which we cannot afford. It is very inconsiderate of them as we are making an effort to pay up.
“I am very disappointed with their attitude - they didn’t bother to inform us when they cut off the supply on Tuesday even though our guards asked them to see us first at our management office,” Lee said.
Syabas corporate communications and public affairs general manager Abdul Halem Mat Som said Syabas would reconnect the water supply depending on the amount of money paid by the JMB to settle the outstanding amount.
“If the Syabas district office agrees to the amount, we will reconnect the water supply. The JMB would then have to pay the balance in installments in addition to the monthly bill,” he said.
Syabas has placed a water tank at the apartment carpark to supply water to the residents.
Condominium, Apartments and Highrise Committee member Peter Chong has promised to help the group by asking Syabas to reconnect the water supply. It is learnt that Syabas agreed to reconnect the water supply yesterday evening.
My fuse box was stolen yesterday. At first, I thought my electricity supply was cut off by TNB so I called TNB to verify this problem as I was never late in making payments and didn't receive any notice. TNB verified to me that my account is clean and there should be no reason for them to cut off my electricity. They asked me to check with the Management office in case the Management office pull out the fuse box for any reason.
When I called Pn Tini from the Management office I was told that this is not the first case. There was some cases before where tenants from other houses which their fuse box was taken out (due to outstanding payments with TNB or their fuse box was spoilt) stole or 'borrowed' other houses fuse box to get their electricity supply back.
I was suprised to know that eventhough there was cases like this before but still you guys the Management did not do anything to prevent this matter. I strongly suggest that you lock up the meter room so that this thing won't be happening again.
The security and well being of each and every tenants of this condo is in your hands, JMB. That is why we are paying you the maintenance fees every month.
I hope you will attend to this matter urgently.

Yes I agree that things have improved drastically from the last time.

To all VDC residents, please check your monthly statement from January 2011 till this months statement (Jan 2012). Some of you might find that the water charges are wrong. The readings has been wrong since 2011 from the time Jaya took over. Apparently, he doesn't know how to read a water meter. You may find that you have been overcharged!

Hi VDC Residents,
I would like to know if the Villa Duta 4 storey condos have been given strata title? Or is it still under Master Title? As far as I'm concern, the Jerah Bina Sdn. Bhd. has winded up status and is no longer in operation.
